TERMS AND CONDITIONS OF ZERO HOURS EMPLOYMENT BETWEEN


(1) Ultimate Staff Limited a company registered in England under registration number 07051421
(hereinafter referred to as “we”, “us” or “the Company”)
(2) __________________________________-- (hereinafter referred to as “you”)

WHEREAS

The Company is an Employment Business which supplies staff to its clients for hospitality events and you are employed as casual event and/or casual promotional event staff and willing to take on assignments for clients from time to time.


IT IS AGREED as follows:


1. General
The following terms and conditions are given to you in accordance with the terms of the
Employment Rights Act 1996, Employment Act 2002, and Working Time Regulations 1998.


2. Duties and Job Title
You are employed as an casual event/ casual promotional event staff


3. Date of Commencement/ Date of Continuous employment


3.1 Your period of employment with us begins on the day you attended your interview.


3.2 In accepting your appointment it shall be deemed that you have accepted all the
terms and conditions set out in this Contract.


3.3 This Contract of Employment annuls any previous agreement whether verbal or
written, given to you at any time.

4. Hours of Work


4.1 Your hours of work will vary according to the workload of the Company’s business.


4.2 It is a condition of your employment that you work flexibly in accordance with the
working arrangements operated by the Company.


4.3 You acknowledge that although the Company will use its best endeavours to allocate
you suitable work when it is available, the Company is under no obligation to provide
you with any work or to provide any minimum number of hours of work in any day or
week.


4.4 You must use your best endeavours to inform the Company when you are unable to
work, although you are not obliged to accept the work we allocate to you.


4.5 Once you have accepted work, you will devote the whole of your time attention and abilities to the work we allocate to
you from time to time.

4.6 Once you have accepted work, if you are unable to undertake it you will let us know as soon as possible by text or telephone call

5. Pay
5.1 You will be paid only for hours you have actually worked. 

5.2 The company applies different rates of pay for different assignments so you do not have a fixed hourly rate. However, the hourly rate payable to you will not be less than the minimum wage applicable at the time.

 

5.3 You will will be paid monthly for all the shifts you do in a month by the 7th of the following month. 

6. Holiday

You are entitled to paid holiday in accordance with the Working Time Regulations 1998/ Your pro rate entitlement is based on the full time statutory entitlement of 5.6 weeks and is 12.07% of hours worked. As you work irregular casual hours and it is not practical for you to book and take paid leave, the hourly rates advertised on our Rota App (our booking platform) for each job are inclusive of holiday pay. 


8. Pensions
There company operates a NEST pension scheme. All Eligible employees will be automatically enrolled into the scheme if they meet certain criteria. Any employee who does not meet the criteria for auto-enrolment can ask to join the scheme anyway.

9. Grievance Procedure
The formal Grievance Procedure is available on request from your Manager.


10. Disciplinary Procedure
The disciplinary rules applicable to your employment are set out in the Disciplinary
Rules and Procedure, which are non-contractual and for guidance purposes only.


11. Staff Handbook and Employment Policies
11.1 All Staff have a duty to adhere to the Company’s other policies from time to time in force,
including but not limited to the Company’s Health and Safety, Fire Safety, Sickness and
Absence and Equal Opportunities Policies.

11.2 You agree that any photos taken when on an assignment for Ultimate Staff or any photos provided by yourself can be used for publicity purposes by Ultimate Staff both online and in print.

11.3 Should you be offered employment directly by any of Ultimate Staff's clients or a third party to whom you were introduced by Ultimate Staff and to do so without the written permission from Ultimate Staff then you will be charged £450. Please note you are also obliged to inform the Company if any of our clients approach you in this way.


12. Termination
12.1 Either party may terminate the contract by:


12.1.1 One week’s written notice where you have been continuously employed by the company
for up to 2 years; and


12.1.2 One additional week’s written notice for every complete year that you have been
employed by the Company after 2 years up to a maximum of 12 week’s notice.

12.1.3 For the avoidance of any doubt any period between assignments does not count towards continuous service.


12.2 The Company reserves the right to terminate your Employment without notice if:


12.2.1 You reject 5 or more jobs allocated to you in succession or fail to attend work
that you have agreed to on 1 or more occasions; or


12.2.2 You are unavailable for work for any reason for 4 or more weeks in
succession.

12.3 Nothing in this Contract of Employment prevents the Company from terminating the
Employment summarily in the event of any serious breach of the terms herein, or in
the event of any act or acts of gross misconduct by you.

12.4 Should you fail to show up for a shift the Company reserves itself a right ot charge you for the loss of profits, cost of finding a replacement and any transport costs that arise from you not showing up as well as a management fee of £100.

13. Health & Safety at Work

The hirer is responsible for your welfare, health and safety whilst working on its site and it is the hirer's responsibility to complete full health and safety training upon your placement. The Company does carry out responsible checks with the hirers prior to placement to seek and establish any known risks and ascertain the steps taken by the hirer to prevent or control such risks. Any relevant information ascertained will be communicated to you prior to the commencement of the assignment.

14. Governing Law and Jurisdiction
These Particulars of Employment shall be governed by and construed in accordance with the
laws of England and Wales. Any dispute relating to the same shall be subject to the exclusive
jurisdiction of the English and Welsh Courts.
